Workers’ Compensation Defense
MMWH regularly represents employers and carriers engaged in such industries as shipbuilding, stevedoring, port terminal operation, railroad transportation, ship repair, longshoring, and other maritime activities involving claims under federal and state workers’ compensation statutes.
We are nationally recognized in the defense of claims under the Longshore and Harbor Workers’ Compensation Act.
Virginia is one of the few states which allows concurrent prosecution under state and federal workers’ compensation statutes. MMWH is one of the few firms in the Commonwealth able to calculate and manage trial strategy based on concurrent claims.
Employment and Labor Law
Our attorneys are dedicated to staying abreast of, and providing comprehensive advice on state and federal employment laws. These laws include discrimination on the basis of race, sex, religion, gender, and disability, as well as wage and hour disputes, non-competition agreements, FMLA and other forms of leave, defamation, and general contract issues.
These laws pertain to everyday questions from drafting employment handbooks and policies, guidance on the hiring and the termination of employees, payment or coverage of employment benefits and general compliance with the variety of labor laws, rules and regulations.
We also have the experience and expertise to represent our clients before the various agencies and courts that consider and resolve employment law cases.
These include the U.S. Department of Labor (USDOL), the Virginia Department of Labor, the Equal Employment Opportunity Commission (EEOC), the Virginia Employment Commission, the U.S. District Court for the Eastern District of Virginia, the Fourth Circuit Court of Appeals, the Virginia Circuit Courts, the Virginia Supreme Court, and the United States Supreme Court.
MMWH represents several national and regional insurance carriers in a variety of insurance matters. We are especially recognized for our defense of tort cases and insurance coverage issues, including automobile, homeowners, commercial general liability, and diverse specialty policies.
MMWH also offers alternative dispute resolution services including mediation and arbitration. Mediation is a cost-effective, confidential method of resolving disputes, whether a lawsuit has been filed or not.
In mediation, a neutral third party (the mediator) assists the parties to negotiate a resolution of their dispute. The mediator does not make rulings or prescribe a resolution to the dispute.
In arbitration, the parties present their evidence to an arbitrator or panel of arbitrators who decide the case and make a ruling. It is similar to litigating in court but can usually be arranged more expeditiously than obtaining a trial date.
